Introduction

The Ministry Of Justice has published some concerning figures that have shaken the country. Between 1 April and 31 October 2025, 91 prisoners were released from prison by mistake in England and Wales. Justice Secretary David Lammy later confirmed this. This has been an alarming safety concern, and a deep realization. These administrative errors reveal that there are serious problems within the UK’s prison system that call for urgent reform and parliamentary scrutiny. 

But how did 91 Prisoners Manage to be freed by Mistake? 

Statistics show that on average 3 prisoners were released every week by accident. This has left politicians and the general public in awe, with many confused on how this is happening. Lammy has stated the reasoning behind this is down to systemic issues within the prison system. This includes understaffing, outdated paper-based systems and the fact that different prisons are using different IT infrastructures. 

Lammy has assured that the police have launched a active search to locate the prisoners and ensured they are returned back to custody. In his statement to parliament he described some of the cases as “complex” and acknowledged a further accidental potential release that occurred on 3rd November is under investigation.

But the 91 Prisoners released in 6 months isn’t an isolated incident…

In the 12 months to March 2025, there were 262 mistaken releases, and more than double the previous year of 115. This is a whopping 128% increase. Out of those 262, 87 involved violence offences and 3 involved sexual offences. 

Lammy has stated that this occurring problem reflects the fact that the prison industry is “under relentless strain.” But critics are arguing that it is bigger than just one-off administrative lapses. A spokesperson for No. 10 cited that the “public are right to be shocked by these cases. These numbers are symptomatic of a system that the government inherited, of a prison system under severe strain, a failing criminal justice system.” 

So what is the government planning to do about this? 

The government has ensured that they aren’t taking these incidents lightly, and are implementing strict measures to reduce the recurrence of this. The government is introducing new reforms to tighten release procedures, introduce modern technology into their systems and restore public trust in the justice system. 

1. Brands New Technology: 

One of the key fundamental elements of the reform is a £10 million investment over the next 6 months to develop and deploy AI-driven tools in prison. This will help assist staff and improve accuracy. Additionally, it means that they won’t have to depend on a cumbersome paper-based process.

2. Stricter and Preciser Checks:

The government is introducing a fast-track courts hotline, staffed by court experts. Through this new system, prisons will be able to escalate queries about outstanding warrants to this unit, ensuring verification before any release. Additionally, courts will be required to confirm imprisonment or release orders verbally with midges, to avoid errors and missteps. This new measure is set to standardise release policy and scrutinize how cases are handled. 

3. Oversight and Accountability: 

With a new monthly Justice Performance Board. Lammy will be the head. The board will monitor how prisons and courts are performing, and examine weaknesses that are in need of reforming. Most importantly, it will oversee prison release errors, in hopes of reducing the likelihood of it recurring in the future. Furthermore, a team of data scientists will analyse historic mistaken-release cases to identify patterns and prevent repeats. 

4. Simplification of Policy: 

Part of the reform involves making the prisoner release policy more simple. This is to improve the accuracy of release date calculations, and avoid errors.

We will have to wait and find out whether the new reform is effective.. However the central element of it all is to restore public confidence. The government know that these recurring errors must stop. Thus by investing in prison systems and implementing swift reform, they hope to repair damage and put an end to these missteps.
